国际社会利益对国际法体系的渗入使得当代国际法律义务越来越具有多边性，并导致了对一切义务法律关系的诞生。ICJ在巴塞罗那牵引公司案中最终确认了对一切义务法律关系，标志着国际法取得了重要发展。然而对于这一法律关系内涵的认识尚未取得多大进展。本文从权利视角研究对一切义务法律关系，对这一法律关系的不同类型进行了界定，并且对两类受害国在援引国家责任方面的不同权利进行了比较。 |

With the permeation of international community interests into international legal system, contemporary international legal obligations have become more and more multilateral, hence giving birth to Obligations Erga Omnes, which were confirmed by ICJ in the Barcelona Traction case. This was really a milestone development for contemporary international law. However, international law scholars have not been very clear about the connotations of Obligations Erga Omnes. This article makes a research on Obligations Erga Omnes from the perspective of rights, defining different types of such legal relations and comparing different rights for two kinds of injured states in revoking state responsibility. |
